The Chair read a statement relative to the Official Plan and Zoning
By-law Amendment listed as Item 2 and the Zoning By-law amendment listed as
item 3 on the agenda. He advised that only those who made oral submissions at
the meeting or written submissions before the amendments were adopted could
appeal to the OMB. He noted that the
applicant may also appeal the matter if Council does not adopt an amendment
within 120 days for Zoning and 180 days or an Official Plan (of receipt of the
application.) He noted that there were
comment sheets available for anyone wishing to submit written comments on these
applications.
He further noted that, with respect to the proposed change to conditions
of draft approval for the plan of subdivision which is Item 8 on the agenda,
only the applicant and those who made oral or written submissions, including a
written request to be notified of any change in conditions, before draft
approval of the plan of subdivision will have the right to appeal any change in
conditions of draft approval.

the Ottawa Built Heritage Advisory Committee recommend that Planning Committee
recommend that Council:
1.
Approve the Terms of Reference for the Briarcliffe
Heritage Conservation District Study as detailed in Document 2;
2.
Enact a by-law to designate the area shown
in Document 1 as a heritage conservation district study area pursuant to
Section 41.1 of the Ontario Heritage Act;
and
3.
Add the properties listed in Document 3 to
the City of Ottawa Heritage Register.

REPORT RECOMMENDATIONS
That the Planning Committee recommend
Council:
1. Approve and adopt an amendment to Volume 2a of the Official
Plan to redesignate 146 Mountshannon Drive from School in the South Nepean
Secondary Plan Area 1, 2 and 3 to Mixed Density Residential, as shown in
Document 1 and detailed in Document 2; and
2. Approve an amendment to the Zoning By-law 2008-250 to change
the zoning of 146 Mountshannon Drive from Residential Third Density Zone,
Subzone Z Exception 1193 (R3Z[1193]) to Residential Fourth Density Zone,
Subzone F Exception 1892 (R4F[1892]H(13.5)) as shown in Document 3 and detailed
in Document 4.
Committee
received the following written submissions, copies of which are held on file
with the City Clerk:

Mary-Ellen Wood,
Planner, provided an overview of the application and staff’s rationale for
recommending approval. A copy of her PowerPoint presentation is held on file
with the City Clerk.
Committee
heard from the following public delegations:
Michael Lakatos, was opposed to the development as proposed. He expressed three concerns, summarized as
follows: Firstly, he was concerned that
the development would cast shadow on the Children’s play area in Mulligan
Park. He was also concerned with the
fact that Mulligan Park would now have to support an additional 221 homes, over
and above the other high-density developments going into the area. He suggested the park was not sufficient to
support the growing community, and suggested the subject site would be more
beneficial to the community if it were parkland. He also expressed concern with
respect to traffic, and surmised that the developer’s initial traffic study had
not been updated to reflect subsequent new development in the area.
Elsa Gebremeskel, Danielle Soum and Marta
Garcia Grandpierre also registered their opposition to the report
recommendations.
Miguel Tremblay, FoTenn Consultants,* spoke in support of the report
recommendation on behalf of the applicant. His PowerPoint presentation included
overview of available amenities in the area, including parkland. He noted
cash-in-lieu of parkland would be provided as part of Site Plan. He confirmed that a traffic study had been
completed and approved by staff, with the most recent addendum in May 2011
responding to community concerns. He confirmed that a Site Plan Control
application had been submitted, and noted the modifications that the developer
had made in response to community concerns, including a reduction in units and
heights.

REPORT RECOMMENDATION
That Planning Committee recommend Council approve entering into a Front-Ending Agreement with Findlay Creek Properties Limited (or related company), for the design and construction of the Leitrim Stormwater Management Pond 2 and into subdivision agreements for repayment of storm sewer oversizing, total reimbursement not to exceed $6,370,796 plus applicable taxes and indexing, as outlined in this report based upon the principles set forth in Documents 1 and 2.
Pierre Dufresne, Tartan Land Corp. was present in support of the report recommendation.

REPORT RECOMMENDATION
That
the Planning Committee recommend Council approve the closure of the segment of
Burgess Avenue, located west of Pulford Crescent.
Natalie Persaud, Planner, provided an
overview of the staff report and recommendation. A copy of her PowerPoint presentation is held
on file with the City Clerk.
Committee heard from one
public delegation. Gary Green, resident of Pulford Crescent, was opposed
to the staff recommendation. He opposed
the addition of the road allowance to the 11 Burgess avenue property and the
sale of that property for development. He suggested the increased lot size
would make it more desirable for developers to build a multiple-unit dwelling.
He also referenced a public meeting held prior to the City’s acquisition of the
Burgess Avenue properties for Transitway construction, indicating residents
were assured that after construction, the properties would be landscaped
parkland and there would be no residential development on the properties. He
spoke to the adverse effect of the pre-construction and construction period on
the neighbourhood.

Control application for restaurant conversion.

of Subdivision for Minto’s development at 370, 404, 410, and 450 Huntmar Drive.
Jack Stirling was present on behalf of Minto and supported
deferral.

REPORT RECOMMENDATIONS
That
Planning Committee recommend Council approve:
1. That
the Bank Street Community Design Plan study be directed to include an
examination of the impacts of outdoor entertainment facilities upon adjacent
land uses.
2. That
the report on the Bank Street Community Design Plan be submitted to Planning
Committee no later than the meeting of Planning Committee in March, 2012
3. That,
in accordance with the Planning Act,
section 38, all outdoor entertainment facilities be prohibited within the area
subject to the Bank Street Community Design Plan Study, such area as set forth
in Attachment 1 to this motion, until April 26th, 2012.

MOTION

Moved by Councillor K. Hobbs:
WHEREAS
the Community Planning and Urban Design Division of the Planning and Growth
Management Department has launched a Community Design Plan (CDP) for a portion
of Bank Street, extending from Riverside Drive to the Canadian National (CN)
rail line located south of Walkley Road;
AND
WHEREAS the CDP shall be the policy backbone to manage significant change in
the Bank Street Study Area;
AND
WHEREAS the CDP is recommending the zoning for the Kaladar area (bounded by
Heron Rd., Kaladar Ave., Brookfield Rd., and the former CPR Tracks), be amended
to change from the current General Industrial subzone(IG1) to a General
Mixed-use subzone(GM-X) to better reflect today’s conditions and meet the
Official Plan’s intention to intensify housing and employment choices in this
area
AND
WHEREAS the potential future presence of an amusement park including outdoor
entertainment facilities may have a negative impact on adjacent existing land
uses;
THEREFORE
BE IT RESOLVED THAT Planning Committee recommend to Council that:
1. The
Bank Street Community Design Plan study be directed to include an examination
of the impacts of outdoor entertainment facilities upon adjacent land uses
2. The
report on the Bank Street Community Design Plan be submitted to Planning
Committee no later than the meeting of Planning Committee in March, 2012
3. In
accordance with the Planning Act,
