REPORT RECOMMENDATION
That the Planning and Environment Committee recommend Council approve
an amendment to the former City of Nepean By-Law to change the zoning of 1884
Merivale Road from Institutional Block 1 (I Block 1) to Industrial Service Zone
(MS) as shown in Document 1 and as detailed in Document 2.

et de l’environnement recommande au Conseil d’approuver une modification au
Règlement de l’ancienne Ville de Nepean en vue de changer le zonage du 1884,
chemin Merivale de zone institutionnelle bloc I (I block I) à zone de service
industriel (MS), comme il est indiqué dans le document 1 et expliqué en détail
dans le document 2.
BACKGROUND
The
applicant owns a 1.18 hectare property located at 1884 Merivale Road. The site is bordered on the north side by
the Merivale United Church and Cemetery and on the south side by the Bukowinian
Greek Orthodox Cemetery.
The
property is currently zoned Institutional Block 1, the exception permitting
"Sample and Showroom". There
is an existing one storey commercial building of approximately 75 square metres
and associated parking. The balance of
the site is unoccupied and undeveloped.
A concurrent Site Plan Control application has been submitted to permit the development of three multi-tenant Industrial Buildings. As the site is bordered by cemeteries and headstones were found to encroach on the development site, an archaeological resource assessment was conducted. The assessment was reviewed by the Ministry of Culture's Heritage Operation Unit and have provided clearance for the work that has been carried out. An application was approved by the Committee of Adjustment to obtain a lot line adjustment to correct the cemetery limits.
DISCUSSION
The City Council Approved Official
Plan designates the property as "Employment Area". The Employment Area designation in this Plan
identify areas where commercial, office and industry are the primary land
uses. Although adjacent uses are
Institutional in nature, the area as a whole was designated to serve as a
centre of employment supplying products and services to the City’s office and
commercial sectors. Therefore, even
though adjacent to historical cemeteries, the site is located in an industrial
area designated for employment related uses.
The former Regional Official Plan designates
the property as "Business Park".
The Business Park designation in this Plan includes industrial and business
parks, research parks, warehousing and manufacturing areas, and other related
non-residential uses.
The former Nepean Official Plan designates the
property as "Business Park".
The Business Park designation in this Plan is intended to provide for
both traditional industrial and current business park uses.
The current zoning of the property is
"Institutional Block 1".
Notwithstanding the permitted uses for an Institutional zone, a
"Sample and Showroom" is also permitted.
The parcel is located within the
heart of the Merivale Employment Area designation under the City Council
Approved Official Plan and the existing zoning already permits as-of-right
"Sample and Showroom" industrial uses. This type of use generally occupies traditional
"multi-occupancy" industrial buildings. The proposed Zoning By-law amendment to Industrial Service (MS)
is consistent with the policies of the Official Plans and is intended to allow
a broader range of uses to be located within the type of building that is
already permitted.
Apart from the abutting cemeteries,
the majority of Merivale Road between Woodfield Drive and Cleopatra Drive is
zoned Industrial Service (MS).
The proposed development will be subject to Site Plan Control.
CONSULTATION
Notice of this application was
carried out in accordance with the City’s Public Notification and Consultation
Policy. The Ward Councillor is aware of
this application and the staff recommendation.
The City did not receive any negative comments or opposition to this
application.
The Ministry of Culture's Heritage Operations Unit and the Ministry of Consumer and Business Services' Cemeteries Regulation Unit required that a Stage 1 and 2 Archaeological Assessment be conducted. This was completed and it was concluded that the development could proceed.
FINANCIAL IMPLICATIONS
This application was not processed by the "On
Time Decision Date" established for the processing of Zoning By-Law
Amendment applications as the applicant needed to conduct a Stage 1 and 2
Archaeological Assessment in order to be able to proceed with the application.
