REPORT RECOMMENDATION
That
the Planning and Environment Committee recommend Council approve an amendment
to the former City of Nepean Zoning By-law to change the zoning of 1 Robertson
Road from Commercial Highway Zone - CH to a Special Permitted Use Commercial
Highway Zone - CH Block X as shown in Document 1 and as detailed in Document 2.

l’environnement recommande au Conseil municipal d’approuver une modification au
Règlement de zonage de l’ancienne Ville de Nepean en vue de faire passer le
zonage du 1, chemin Robertson de zone de commerce routier – CH à zone de
commerce routier assortie d’une utilisation permise spéciale – CH Bloc X telle
qu’elle est indiquée dans le document 1 et détaillée dans le document 2.
BACKGROUND
The subject property is an irregular shaped lot
located on the north side of Robertson Road at the intersection with Richmond
Road. The property is 1 090 m2 with
42.3 metres of frontage. To the east
and west of the site are existing restaurants.
The existing building has been used, until recently, as a restaurant. The applicant intends to convert the building into a business office. The highway commercial zone does not permit a business office use, therefore an amendment to the Zoning By-law is required.
DISCUSSION
The City Council Approved Official Plan
designates the properties along Robertson Road as Main Street, which permits a
mix of uses including business offices.
The property is designated Business Park in the former Regional Official
Plan. The Business Park designation
permits business offices along with a variety of other employment uses.
The former City of Nepean Official Plan designates this property as part
of the Bells Corners Commercial Sector, which consists of interrelated
commercial and service oriented uses, including business office uses.
The property is zoned Commercial Highway Zone – CH, which only permits a
restaurant and lodging use. A business
office will generate less traffic than the existing restaurant and require only
one third of the parking spaces. The
property is large enough to accommodate all the required parking in accordance
with the applicable Zoning By-law.
The addition of business office as a permitted use on this property is consistent with the policies of the Official Plans by creating a mix of non-conflicting uses along a Main Street corridor.
CONSULTATION
Notice of this application was carried out in accordance with the City’s Public Notification and Consultation Policy. Information signs were posted on-site indicating the nature of the application. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
FINANCIAL IMPLICATIONS
This application was processed by the "On Time
Decision Date" established for the processing of Zoning By-Law Amendment
applications.
