DISCUSSION

The Delegation of Authority By-law No. 2011-28, enacted by City Council on 26 January 2011, provides Delegated Authority to approve and conclude Real Estate transactions involving Acquisitions, Disposals and Leasing of Real Property.  Sections 66 and 67 of Schedule “A” of the By-law provides the Delegated Authority to approve and conclude real property transactions at four staff levels.

 

Delegated Authority to approve and conclude Real Estate transactions dealing with acquisition and disposal of real property are subject to the provisions of Disposal By-law No. 2002-38 and the Acquisition of Real Property Corporate Policy.  Prior to the acquisition or disposal by Delegated Authority, all criteria of the said By-law and Policy must be met.

In addition, By-law No. 2009-354, enacted by City Council on 28 October 2009 as an amendment to By-law No. 2002-38, delegates authority to the Director of Real Estate Partnerships and Development to declare non-viable property surplus, subject to specified conditions.

 

Subsections 66(6) and 67(5) of Schedule “A” of By-law No. 2011-28, as amended, and subsection 2A(2) of By-law No. 2002-38, as amended, require that the exercise of Delegated Authority shall be reported to the Finance and Economic  Development Committee on a semi-annual basis.  This report covers the first half of the reporting period for 2011.

 

The Real Estate Partnerships and Development office (REPDO) certifies that all transactions approved under Delegation of Authority for the period of 1 July to 31 December 2011 are in compliance with the Delegation of Authority By-law and Disposal By-law.
