By-Law No. 2011-28, “a by-law of the City of Ottawa respecting the delegation of authority to various officers of the City” was enacted by Council at its meeting of January 26, 2011.

 

This By-Law provides delegated authority to officers within the Public Works Department and requires that use of delegated authority be reported to the appropriate standing committee at least once per year.

 

PURPOSE:

 

The purpose of this IPD Memo is to report to the Finance and Economic Development Committee on the use of delegated authority for 2011 by the Parks, Buildings and Grounds Operations and Maintenance Branch of the Public Works Department specific to Sections B 32(1) – Lansdowne Park and B 33(1) – Utility Contracts of Schedule ‘B’ – City Operations Portfolio of By-Law No. 2011-28.

 

BACKGROUND:

 

The Parks, Buildings and Grounds Operations and Maintenance Branch of the Public Works Department provides centralized management of the City’s parks, buildings, and grounds including 52,000 acres of land, 9.1 million square feet in 795 buildings and 2,882 hectares of parkland in more than 944 sites. 

 

Parks, Buildings and Grounds functions as a one-stop shop for proactive operations and maintenance of the City’s parks, buildings, and grounds on a 24/7 basis and includes the following three divisions:

 

·    Special Operations;

·    Building and Technical Support; and,

·    Parks, Buildings and Grounds Area Operations (East, West, Core, South).

 

The mandate of the Special Operations Division is to manage, operate and maintain the City’s unique assets and facilities specific to current or potential opportunities for revenue generation, financial self-sufficiency and reduced need for tax support.  Some of these unique major business units include Lansdowne Park, Lynx Stadium and the Corporate Administration Portfolio.

 

Specific to Lansdowne Park, Section B 32(1) – Lansdowne Park of Schedule ‘B’ – City Operations Portfolio of By-Law No. 2011-28 delegates individual authority to the Deputy City Manager – City Operations, the General Manager – Public Works Department, the Manager – Parks, Buildings and Grounds Operations and Maintenance Branch, the Manager – Special Operations and the Program Manager – Lansdowne Park to negotiate and execute routine short-term rental agreements, event contracts, license agreements or licenses of occupation as they relate to the use of facilities or services within Lansdowne Park provided that,

 

            (a)        the monetary value of the agreement is $250,000 or less;

            (b)        the agreement complies with all applicable Council policies; and

            (c)        all applicable provision of By-Law No. 50 of 2000, as amended, being the City’s Purchasing                    By-Law have been met.

 

The Building and Technical Support Division is responsible for energy management including the procurement of electricity and natural gas, building engineering, accommodations and trades.

 

With regard to the procurement of electricity and natural gas, Section B 33(1) – Utility Contracts of Schedule ‘B’ – City Operations Portfolio of By-Law No. 2011-28 individually authorizes the Deputy City Manager – City Operations, the General Manager – Public Works Department and the Manager – Parks, Buildings and Grounds Operations and Maintenance Branch to purchase electricity and natural gas and execute utility contracts provided that,

 

            (a)        the purchases comply with the Council-approved Corporate Utility Procurement Policy;

            (b)        the form and content of the contract has received approval from the City Clerk and Solicitor;                   and,

            (c)        the purchase is within approved budget projections for the term of the contract.

 

Sections B 32(1) and B 33(1) respectively, identifies that use of delegated authority under these sections be reported to the Finance and Economic Development Committee at least once per year.

 

DISCUSSION:

 

The following summary for the use of delegated authority under Sections B 32(1) and B 33(1) as described above is provided with specific details for each attached as Documents 1 and 2.

 

Section B 32(1) – Lansdowne Park:

 

As described in Document 1 attached, the delegated authority under Section B 32(1) was used in 2011 for 88 events that included 151 event days, totaling $1,512,211.83 in rent income.

 

Section B 33(1) – Utility Contracts:

 

As described in Document 2 attached, the delegated authority under Section B 33(1) was used three times in 2011 to execute utility contracts associated with the purchase of natural gas beginning in 2012 and totaling $1,513,100.00.

 

These payments are not made as a lump sum but are made monthly at the consumption rate established by the City’s Energy Management Unit (to be confirmed)
