That License Committee consider the status of Mr. Awais Mohamed Hassan’s Taxi Plate Holder License.

During
the public transit strike, there was an increased demand on Ottawa’s licensed
taxicabs. This demand also resulted in an increased use of taxi coupons or
“chits” for a number of fares. In January 2009, the City of Ottawa rolled out a
program to assist vulnerable members of the community to obtain necessary
transportation through the use of taxi coupons. The Chief License Inspector’s review of taxi coupons used during
the transit strike identified irregularities associated with a select number of
licensed taxicab drivers.
The
Licensee is the holder of Taxi Plate Holder License No. 503. A review of taxi
coupons associated with Taxicab No. 503 revealed irregularities and further
indicators of suspected misuse of taxi coupons thereby impacting upon public
funds. The Chief License Inspector considers that this conduct may be a breach
of the Taxi By-law 2005-481, and further such conduct may be adverse to the
public interest. Pursuant to Section 76
of the Taxi By-law, the Chief License Inspector herein requests the License
Committee to conduct a status review hearing into the Licensee’s taxi plate
holder license.

LICENCE
COMMITTEE POWERS
71 (1) The Licence Committee is
authorized to administer the provisions of this by-law.
(2) The
License Committee is authorized to make the final decision in respect of the
revocation or suspension of any license issued or the imposition of conditions
on any licensee.
(3) A
majority of the three (3) members of the Licence Committee constitutes a
quorum.
(4)
The Licence Committee, after a hearing, may revoke any or each of the
licences held by a licensee for cause and without limiting the generality of
the foregoing for:
(a)
a breach of the law,
(b)
anything which may be in any way adverse to the public interest,
(c)
the belief that the person will not carry on or engage in the business in
accordance with the law or with honesty and integrity,
(d)
any other manner which the Licence Committee is authorized by
law to consider, or
(e) any violation of the provisions of this by-law.
The
Licence Committee may suspend a licence for cause for any period that is less
than the unexpired part of the period for which it was issued in lieu of the
revocation as provided in subsection (4).
(5)
The Licence Committee may impose conditions as a requirement of
obtaining, continuing to hold or renewing the licence, including special
conditions.
REPORT FOR REVIEW OF STATUS OF LICENSEE
76. The Chief Licence Inspector may report to the
Licence Committee any breaches by the licensee of this by-law with a request to
consider the status of the licence.
Mr. Awais Mohamed Hassan has been notified of the date and time of the hearing, and has been provided with a copy of this report.
FINANCIAL IMPLICATIONS
There are no financial implications associated with this report.
DISPOSITION
The Chief License Inspector to
implement the decision of License Committee accordingly.
