DISCUSSION

 

The Delegation of Authority By-law 2001-12, as amended, approved by City Council on 8 January 2001, provides delegated authority to approve and conclude real estate transactions involving acquisitions, disposals and leasing of real property.  Schedule “F”, Section 24 of the By-law, provides the delegated authority to approve and conclude real property transactions at five staff levels.

 

Delegated authority to approve and conclude real estate transactions dealing with disposal of land and property are subject to the Disposal By-law 2002-38.  All criteria of the said By-Law must have been met prior to the disposal by delegated authority.

 

Section 24 - 4C of By-law 2002-520 requires that the exercise of delegated authority shall be reported to Corporate Services and Economic Development Committee on a semi-annual basis.  This report covers the first half of the reporting period for the year 2005.

 

Real Estate Services certifies that all transactions approved under Delegation of Authority for the period of 1 January to 30 June 2005, are in compliance with the Delegation of Authority By-Law and Disposal By-law.

Public consultation not required.

 

 

FINANCIAL IMPLICATIONS

 

Prior to transaction approval, Real Estate Services staff confirms with Financial Services staff that the appropriate funds are available in the budget.  The availability of funds is a condition and requirement of approval under Delegated Authority.

Attached as Document 1, is a list of real estate acquisition, disposal and lease transactions approved under Delegation of Authority from 1 January to 30 July 2005.
