REPORT RECOMMENDATIONS

 

That the Corporate Services and Economic Development Committee recommend Council:

 

1.         Declare a vacant parcel of land shown as Parcel 2 on Annex “A” attached, containing approximately 991.7 m2, described as being Part of Scot Street, Registered Plan 689, Township of West Carleton, now in the City of Ottawa, and shown as Parts 5 and 6 on a draft plan of survey prepared by Paul A. Riddell Ltd. (Reference No. 03-8513) subject to the road being stopped up and closed by by-law, as surplus to the City’s needs;

 

2.         Approve the sale of the land detailed in Recommendation 1, subject to a drainage easement in favour of the City of Ottawa over Part 5 on a draft plan and together with and subject to a right-of-way in favour of the other abutting owners and any other easements that may be required, to John Murray Davison and Margot Davison for the amount of $4,140.00, plus GST, pursuant to an Agreement of Purchase and Sale that has been received.

 

RECOMMANDATIONS DU RAPPORT

 

Que le Comité des services organisationnels et du développement économique recommande au Conseil municipal :

 

1.         de déclarer une parcelle de terrain vacant indiquée comme étant la parcelle 2 de l’annexe A ci-jointe, couvrant environ 991,7 m2, décrite comme faisant partie de la rue Scot, plan enregistré 689, ancien Canton de West Carleton maintenant Ville d’Ottawa, et désignée comme étant les parties 5 et 6 du plan d’arpentage provisoire préparé par Paul A. Riddell Ltd (No de référence 03-8513) sous réserve d’une fermeture de rue par règlement municipal, excédentaire aux besoins de Ville;

 

2.         d’approuver la vente du terrain indiqué à la recommandation 1 à John Murray Davison et Margot Davison  pour la somme de 4 140 $, TPS non comprise, conformément à la convention d’achat-vente reçue et sous réserve d’une servitude de drainage en faveur de la Ville d’Ottawa sur la partie 5 du plan d’arpentage provisoire et d’un droit de passage en faveur des propriétaires voisins et de toute autre servitude qui pourrait être requise.

 

 

BACKGROUND

 

A road closing application was submitted by Mr. & Mrs. Sucee, the owners of Lots 53 and 54 on Plan 689, to the Development Services Department to close all of Scot Street as shown in heavy outline on the attached sketch marked Annex “ A”.  The subject road allowance also abuts two other properties described as Lots 32, 33, 34 and 53, Plan 689.  Agreement has been reached with all three abutting property owners to purchase the portions of the road allowance abutting their property and the conveyance of the road allowance to the other two owners (Mr. & Mrs. Sucee and Ms. Margaret MacKay) are the subject of separate reports.

 

Scot Street is an untravelled road allowance in the former Township of West Carleton and is located within Registered Plan 689 between Maple Lane and Barlow Crescent.  This road allowance is the subject of a lease agreement between the former Township of West Carleton and Mrs. MacKay, the owner of Lots 33 and 34 on Plan 689.  This lease agreement was to allow Mrs. MacKay authorization to construct a driveway to provide vehicular access to Lots 33 and 34 when she decided to construct a residence on these lots.  Mrs. MacKay’s property has frontage on Barlow Crescent, however, it is not accessible from Barlow Crescent because of the topography.  This lease will be cancelled with the conveyance of road to be closed to the abutting owners, and also the registration of a permanent right-of-way over a portion of the road to be closed in favour of the three abutting owners.

 

The application submitted to the Development Services Department to close Scot Street has been approved, subject to the following conditions:

 

  1. That the closing be undertaken by By-law;

 

  1. That prior to enactment of the closing by-law, the applicant shall provide the following material to the satisfaction of the City Solicitor:

 

a)      A plan of survey showing the roadway link to be closed and the lands to be conveyed to all parties, as well as any utility easements;

 

b)      Draft deeds of the lands to be conveyed, ready for execution;

 

c)      Registration of all documents and the costs thereof;

 

  1. Should the conditions of the Delegated Authority Report not be fulfilled within one year of the approval of the City Council, the recommendations of the road closing approval will become null and void;

 

  1. That prior to the passage of the required street closure by-law, the City shall complete the advertising of the proposed closure as per the requirements of the Municipal Act;

 

  1. That the existing lease agreement with the owner of Lots 33 and 34 on Registered Plan 689 be released and that a permanent right-of-way be established with the Scot Street road allowance to the benefit of Lots 32, 33, 52 and 53;

 

  1. That an easement for storm water drainage purposes be provided to the satisfaction of the City.

 

 

DISCUSSION

 

The three abutting owners have elected to purchase the road allowance abutting each of their respective properties. The total road allowance is described as Parcels 1, 2 and 3 on Annex A, attached, being Parts 1, 2, 3, 4, 5 and 6 on a draft plan of survey prepared by Paul A. Riddell Ltd. (Reference No. 03-8513).

 

An agreement has been reached with Mr. & Mrs. Davison for the purchase of that portion of Scot Street described as Parts 5 and 6, subject to a permanent right-of-way over Part 5 in favour of the other two abutting owners and the grant of an easement over Part 5 for storm water drainage, in the amount of $4,140.00.

 

The zoning of the City property is RR (Rural Residential Zone) with the Official Plan designation of  (Twp. of West Carleton – Marginal Resource and RMOC – General Rural Area).  The intended use by Mr. & Mrs. Davison is to incorporate the property into their current property and does not intend to rezone. 

 

The remaining portions of Scot Street are the subject of separate companion reports dealing with the sale of the road to be closed to the other two abutting owners, John and Kim Sucee and Barbara MacKay.

 

The sale price is within the market value range established by an independent appraisal report.

 

The offer is considered fair and reasonable and is recommended for acceptance.

 

 

FINANCIAL IMPLICATIONS

 

This transaction represents revenue of $4,140 to the Corporation and will be credited to Account No. 119909-407217.
