REPORT RECOMMENDATIONS

 

That the Corporate Services and Economic Development Committee recommend Council approve:

 

1. A by-law to make provision for reduced opening hours on voting day in certain institutions and retirement homes in accordance with provisions in the Municipal Elections Act, 1996; and

 

2. The reduced hours of operation for these facilities be either from 10 a.m. to 2 p.m. or from 4 p.m. to 8 p.m. as shown in Schedule ‘A’ to the by-law.

 

RECOMMANDATIONS DU RAPPORT

 

Que le Comité des services organisationnels et du développement économique recommande au Conseil d’approuver :

 

1. un règlement municipal permettant de réduire les heures d’ouverture le jour du scrutin dans certains établissements et maisons de retraite, conformément aux dispositions de la Loi de 1996 sur les élections municipales;

 

2. la réduction des heures d’ouverture dans ces installations, soit de 10 h à 14 h, soit de 16 h à 20 h, selon ce que prévoit l’annexe A du règlement municipal.

BACKGROUND

 

Council may pass a by-law providing for reduced opening hours on voting day of a voting place that is only for the use of residents of an institution or retirement home.  The criteria for the application of this authority are set out in subsection 45(7) of the Municipal Elections Act, 1996 (the Act) and include an institution in which, on nomination day, 20 or more beds are occupied by persons who are disabled, chronically ill or infirm, and a retirement home in which, on nomination day, 50 or more beds are occupied.

 

The purpose of this authority is to increase the efficiency of the voting process as many of these premises can be served in much less than the 10 hours required for regular voting places.  It is the intention of the Elections Office to schedule activity so that one election team can serve two facilities on voting day.

 

 

DISCUSSION

 

For the 2000 elections, the Ottawa Transition Board enacted a by-law to allow for reduced opening hours for certain institutions and retirement homes.  The by-law was only applicable to that election and a new by-law is required for the 2003 election.  The hours used at that time were 10 a.m. to 2 p.m. and from 4 p.m. to 8 p.m.  Since the system worked well, it is proposed that the same arrangement and times be used for the 2003 election.

 

All institutions and retirement homes for which voting places must be provided have been considered in this process.  Elections staff have consulted with the management of each eligible facility to jointly identify the sites where reduced hours of operation will be feasible.  These locations are set out in the schedule to the proposed by-law and a copy of the list is attached as Annex 1.

 

Facility administrators are also asked to provide resident listing information to Elections staff in September for purposes of updating the voters’ list.  In mid-October an elections notification letter will be sent to each resident whose name appears on the voters’ list indicating the date and hours for voting to ensure that the residents are fully aware of their scheduling.

 

Notwithstanding the reduced hours for voting, there is a guarantee in subsection 46(4) of the Act that if an elector in the voting place has not yet voted during the scheduled time of voting, and wishes to vote, then the voting facility will remain open until such person has voted.

 

 

CONSULTATION

 

Consultation has occurred with the management of affected institutions and retirement homes.

 

 

FINANCIAL IMPLICATIONS

 

Resources are provided within the 2003 elections budget.  There is no additional financial requirement related to the passing of the recommended by-law.
