That the Corporate Services and Economic Development
Committee recommend Council:
1. Declare a
vacant parcel of land shown on Annex “A” attached, containing approximately
154.7 m2, described as being part of the lane on Registered Plan
207509 described in PIN 04026-0189 and indicated as Parcels 1, 2, 3, 5 and 6,
City of Ottawa, subject to the road being closed by by-law, as surplus to the
City’s needs;
2. Approve the
sale of the land detailed in Recommendation 1, and indicated as Parcels 1, 2,
3, 5 and 6 on the attached sketch, subject to an easement to Hydro Ottawa and
Bell Canada, together with a maintenance easement in favour of the owners of
263 Harmer Avenue South as indicated as Parcel 1 on the attached sketch that
may be required, to Alison B. Cherniuk, for the amount of $10,850.00 plus GST,
pursuant to an Agreement of Purchase and Sale that has been received.

DU RAPPORT
Que le Comité des services organisationnels et du
développement économique recommande au Conseil :
1. de déclarer une
parcelle de terrain vacante représentée sur l’annexe A ci-jointe, d’une
superficie d’environ 154,7 m2, décrite comme une partie de l’allée
sur le plan enregistré 207509 indiquée dans le PIN 04026-0189 et dénotée comme
les parcelles 1, 2, 3, 5 et 6, ville d’Ottawa, sous réserve de la fermeture du
chemin par voie de règlement municipal, excédentaire aux besoins de la Ville;
2. d’approuver la vente
du terrain précisé dans la recommandation 1 et désigné comme les parcelles 1,
2, 3, 5 et 6 sur l’esquisse ci-jointe, sous réserve d’une servitude consentie à
Hydro Ottawa et à Bell Canada, assortie d’une servitude d’entretien pouvant
être requise au profit des propriétaires du 263, avenue Harmer Sud, indiquée
comme la parcelle 1 sur l’esquisse ci-jointeà Alison B. Cherniuk, pour la somme
de 10 850 $, la TPS en sus, conformément à une convention d’achat et de vente
qui a été reçue.
A
road closing application was submitted on behalf of Alison B. Cherniuk, owner
of 265 Harmer Avenue South, to the Development Services Department to close all
of the laneway as shown on the attached sketch marked Annex “ A” and detailed
as Parcels 1 to 5.
The
lane to be closed is located in the middle of a low-density residential
neighbourhood and abuts 265 Harmer Avenue on the north, 335 Harmer Avenue, 336
Ruskin Street and 299 Ruskin Street on the south. The lane is currently not maintained by the City and is not essential
as a public road.
The lane to be closed was
offered for sale to all abutting property owners. Only the owners of 265 Harmer Avenue South, the applicant and the
owner of 299 Ruskin Street elected to purchase that portion of the lane
abutting their property. Parcels 1, 2 3
and 5 are to be conveyed to the applicant, Alsion Cherniuk and Parcel 4 is to
be conveyed to Dwayne and Ellen Wright, owners of 299 Ruskin Street.
The
application to close the lane has been approved by the Director of Planning and
Infrastructure Approvals Branch, Development Services Department, subject to
the following conditions:
1. That the
closing be undertaken by By-law.
2. That prior
to enactment of the closing by-law, the applicant shall provide the following
material to the satisfaction of the City Solicitor:
a) A
plan of survey showing the roadway link to be closed and the lands to be
conveyed to all parties, as well as any utility easements;
b) Draft
deeds of the lands to be conveyed, ready for execution;
c) Registration
of all documents and the costs thereof.
3. That the
Closing By-law not be forwarded to Council unless and until the property owner
eligible to acquire that portion of the lane to be closed, files a letter with
the Director of Property Law acknowledging that any zoning violation which may
result from the closure will be the affected property owner’s responsibility to
remedy.
4. That the
portion of the lane to be closed be offered to the abutting property owner(s)
on the terms and conditions to be established by the Development Services
Department and approved by City Council.
5. That the
closing of the lane be contingent upon acceptance by the abutting property
owner(s) of the price approved by City Council.
6. Should the
conditions of this report not be fulfilled within one year of this approval the
recommendation of this report shall be null and void.
7. Prior to
the conveyance of the lane, a maintenance agreement over the lands indicated as
Parcel 1 will be granted in favour of the owner of 263 Harmer Avenue South.
This will allow them to perform maintenance on the side of their home abutting
the lane. Documents to be prepared and
registered by the applicant.
The lane to be closed is no
longer required by the City and will not deny sole vehicular access to other
properties. The sale of the lane to be closed will permit the abutting property
owners who elected to purchase the lane to enlarge their holdings.
The zoning of the City
property is R1J – Residential Detached. The intended use by Ms. Cherinuk is to
incorporate the lane into her adjoining lands, which are, also zoned R1J.
The sale price is within the
market value range established by an appraisal report. The offer is considered fair and reasonable
and is recommended for acceptance.
CONSULTATION
Notice of the Street Closure
and Sale to the abutting owners has been advertised in accordance with the
Municipal Act.
In accordance with existing
policies, the property was circulated to all City Departments. The circulation included the City's Housing
Branch, Development Services and the Ward Councillor as well as outside
agencies and utility companies. Subject to the required easements being
retained, no objection to the lane closing and sale of the land to the abutting
owners was expressed.
FINANCIAL IMPLICATIONS
This transaction represents
revenue of $10,850.00 to the City and will be credited to Profit Centre
119909-407217.
