That the
Corporate Services and Economic Development Committee recommend that Council
1. Declare a 559 m2 parcel of land located at
3050-3054 Woodroffe Avenue, described as Parts 1, 10, 11, and 12, Plan
4R-11431, and shown on Annex “A”, as surplus to City requirements;
2. Approve the sale of the property referred to in Recommendation
1 to Bell Canada for $92,350.00 plus GST, subject to an easement over Part 10
in favour of Hydro Ottawa, pursuant to an Agreement of Purchase and Sale that
has been received.

TPS, sous réserve d’un droit de passage sur la partie 10 à la faveur de Hydro
Ottawa, conformément à une convention d’achat-vente adoptée.
In 1990, the former City of Nepean purchased from the Ministry of Transportation and Communications a 0.55 ha property situated in the northwest corner of the intersection of Woodroffe Avenue and Queensbury Drive. The Ministry acquired the property for roadway purposes, however, a change in highway requirements resulted in its selling the land to Nepean to be used in conjunction with an industrial/business park development that was contemplated for the area.
In 1993, Nepean entered into a 20-year lease with Bell Canada to enable the installation of a Controlled Environment Vault on a portion of the site. The leased parcel contains an area of 375 m2 and is situated in the northwest corner of the property. Nepean also granted permanent easement rights to both Bell and Nepean Hydro to install underground cables along the entire northerly limit of the property.
As a result of changes to flight path restrictions on land use, the area initially contemplated for industrial park was developed with residential uses, and it was then determined that the subject property would not be required for its intended purpose. Although Nepean actively sought to dispose of the property, it never received an acceptable offer. Through the amalgamation process, the property became part of the new City of Ottawa’s real estate inventory.
The lease agreement between Bell Canada and the former City of Nepean provided that in the event the City wished to dispose of its property, Bell would have the right to purchase the land in terms of its appraised value. When Bell was notified of the City’s intent to dispose of 3050-3054 Woodroffe Avenue, it indicated that it wanted to purchase the leased land, together with an additional 184 m2 parcel of adjacent land for future expansion of its facility.
Negotiations with Bell Canada resulted in an Agreement to sell the leased lands, described as Parts 1, 10, and 11, Plan 4R-11431, subject to an easement to Hydro Ottawa over Part 10, together with an additional 184 m2 parcel of land described as Part 12 on Plan 4R-11431, for $92,350.00 plus GST. The Agreement is conditional for a period of 30 days from the date of approval upon Bell obtaining pedestrian and vehicular access to its facility from Longshire Circle. In the event Bell obtains access from Longshire Circle, it has agreed to eliminate its present access from Woodroffe Avenue.
Compensation was based on an appraisal that estimated the present worth of Bell’s lease payments (leased fee interest) to be $71,000.00 over the term of the lease, together with the market value of the additional 184 m2 of land estimated to be $21,353.00.
The offer is considered fair and reasonable and is recommended for acceptance.
PUBLIC
NOTIFICATION / CONSULTATION
In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all client City Departments, including the Housing Branch, and Comprehensive Asset Management Division to determine if it should be retained by the City to be used in conjunction with any mandated program. Neither the Housing Branch nor any City Department expressed interest in the property. Local governments and external agencies were also circulated, but none expressed interest in acquiring the property. The Ward Councillor was advised of the proposal and has no objections or concerns with staff’s recommendation. A for sale sign was erected on the property, making it available to the general public.
FINANCIAL IMPLICATIONS
The sale of this property will result in revenue of $92,350.00 to the City. This revenue will be credited to Profit Centre 119909-407217.
