Use of Delegated Authority during 2011 by By-law and Regulatory Services, as set out in Schedule “B”, City Operations Portfolio, By-law 2011 - 28

OBJET :

L’utilisation de la délégation de pouvoirs en 2011 par Services des règlements municipaux, comme il est indiqué à l’annexe B du portefeuille des Opérations municipales, du règlement 2011 - 28

 

Through Schedule “B” to By-law No. 2011 - 28, being the Delegation of Authority By-law, Council delegated a number of administrative authorities to By-law and Regulatory Services Branch to promote efficiencies and recognize operational processes.  Delegated authority is exercised pursuant to certain conditions established by Council in the by-law, including the requirement to report back to the applicable Standing Committee.  On that basis, the information below with respect to the use of delegated authority by By-law and Regulatory Services in 2011 is provided to the Community and Protective Services Committee.

 

Dog Owners’ Liability Act

 

Section 20 of Schedule “B” of the Delegation of Authority By-law authorized the Manager, By-law and Regulatory Services to commence, maintain and settle proceedings pursuant to the Dog Owners’ Liability Act.  In 2011, six (6) proceedings were commenced with five (5) settled and one (1) ongoing.

 

Parking Ticket Revenue Sharing

 

Section 21 authorized the Manager, By-law and Regulatory Services to negotiate, execute, and amend agreements respecting parking ticket revenue sharing with public service agencies or institutions.  This authority was not exercised in 2011.

 

Fire Routes (Designation and Signage)

 

Section 22 authorized the Manager, By-law and Regulatory Services to approve amendments to By-law No. 2003-499, as amended, being the Fire Routes By-law, to: designate fire routes required as a result of a site plan approval or a building permit; extend the timeframe for the enforcement of fire route signage existing at the time of the enactment of By-law No. 2003-499; and, take any steps necessary to ensure the harmonization of fire route signage.  In 2011, twelve (12) fire routes were designated; there were no instances of extending the timeframe for the enforcement of fire route signage, and 9 (nine) property owners/managers were contacted with respect to the harmonization of fire route signage pertaining to their various properties.

 

Community Events (Special Occasion Permits)

 

Section 23 authorized the Manager, By-law and Regulatory Services to approve an event as a community festival or to approve an event to be held outdoors in a public park and the location of such event in a public park, when a request for such approval is submitted as part of an application to the Alcohol and Gaming Commission of Ontario (AGCO) for issuance of a Special Occasion Permit.  During 2011, fifty two (52) events were approved as community festivals and thirty-eight (38) events were approved to be held outdoors in a public park, where each had submitted a request as part of an application to the AGCO for a Special Occasion Permit.

 

Animal Control Tribunal

 

In 2006, Council approved the delegation of authority to act as the Animal Control Tribunal, to the Director of By-law and Regulatory Services, or his/her designate, as appointed by Council.  In accordance with the provisions of the Animal Care and Control By-law, the Tribunal hears appeals to Orders to muzzle/leash dogs which have bitten or attacked a person or domestic animal.  These Orders are issued to the owners of the dogs by By-law Enforcement Officers.  In 2011, the Animal Control Tribunal held seven (7) hearings, and heard and rendered decisions on twenty-nine (29) appeals to muzzle/leashing Orders.
