QUARTERLY PERFORMANCE REPORT TO COUNCIL, Q2: APRIL 1 – JUNE 30, 2012 ACS2012-CMR-OCM-0017 CITY WIDE That the Agriculture and Rural Affairs Committee receive this report for further review and discussion of the service areas’ performance results, as outlined in the attached report. CITY OPERATIONS EMERGENCY AND PROTECTIVE SERVICES DEPARTMENT 3. UPDATE – KENNEL LICENSING REGULATIONS ACS2012-COS-EPS-0029 CITY WIDE That the Agriculture and Rural Affairs Committee recommend that Council approve amendments to: 1. the Licensing By-law (By-law No. 2002-189), as detailed in Document 1, to establish harmonized regulations for the licensing and regulating of kennels and of in-home breeding establishments; and, 2. the Animal Care and Control By-law (By-law No. 2003-77) to exempt in-home breeding establishments from the limit on the number of dogs or cats that may be kept in a dwelling unit. ENVIRONMENTAL SERVICES DEPARTMENT 4. MONAHAN CREEK MUNICIPAL DRAIN MODIFICATIONS ACS2012-COS-ESD-0021 STITTSVILLE (6)/RIDEAU-GOULBOURN (21)/KANATA SOUTH (23) That the Agriculture and Rural Affairs Committee recommend that Council adopt the Engineer’s Report prepared by Robinson Consultants Inc., entitled Amendment to the Engineer’s Report for the Monahan Creek Municipal Drain Modifications and Improvements dated June 2012, for a drainge works project under Subsection 78 of the Drainage Act with respect to the existing drainage works known as the Monahan Creek Municipal Drain and give 1st and 2nd reading to the By-law attached as Document 2 to this report in accordance with Sections 42 and 45 of the Drainage Act of Ontario. PLANNING AND INFRASTRUCTURE PORTFOLIO PLANNING AND GROWTH MANAGEMENT DEPARTMENT 5. ALL TERRAIN VEHICLES ON CITY ROADS AND ROAD ALLOWANCES ACS2012-PAI-PGM-0205 CITY WIDE That the Agriculture and Rural Affairs Committee receive this report for information. 6. PROHIBITION, INSPECTION AND REMEDIATION OF BUILDINGS USED FOR MARIJUANA GROW OPERATIONS ACS2012-PAI-PGM-0091. CITY WIDE That the Agriculture and Rural Affairs Committee and Planning Committee recommend to Council: 1. Approve the service delivery model and fee structure for the prohibition, inspection and remediation of buildings used for marijuana grow operations, as outlined in this report and summarized in Document 1; 2. Approve the By-law substantially in the form of Document 2, pertaining to the prohibition, inspection and remediation of buildings used for marijuana grow operations; and 3. Direct staff to prepare comments on Health Canada’s proposed regulations with respect to the production and distribution of medical marijuana that will reform the Marijuana Medical Access Program, and report back to City Council early in 2013. 7. OFFICIAL PLAN AMENDMENT - NATURAL HERITAGE SYSTEM MAPPING, LESTER ROAD WETLAND COMPLEX, KIZELL DRAIN WETLANDS AND THE CARDINAL CREEK KARST ACS2012-PAI-PGM-0214 CITY WIDE That Agricultural and Rural Affairs Committee and Planning Committee recommend Council: 1. Approve and adopt an amendment to the Official Plan to amend policies related to the Natural Features and Functions, Environmental Impact Statement and Implementation as detailed in Document 1; 2. Approve and adopt an amendment to the Official Plan to include the Natural Heritage System Overlays, as shown in Schedules 1, 2 and 3 of Document 1 as Schedules L1, L2 and L3, respectively, of the Official Plan; 8. ZONING – 7479 BLEEKS ROAD ACS2012-PAI-PGM-0216 RIDEAU – GOULBOURN (21) That the Agriculture and Rural Affairs Committee recommend Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 7479 Bleeks Road from RU, Rural Countryside to RU[XXXr] and RU[YYYr], as shown in Document 1 and as detailed in Document 2. 9. ZONING – 4782 HAWTHORNE ROAD ACS2012-PAI-PGM-0200 OSGOODE (20) That the Agriculture and Rural Affairs Committee recommend Council approve an amendment to the Zoning By-law 2008-250 to change the zoning of 4782 Hawthorne Road from ME (Mineral Extraction) to ME[XXXr], as shown in Document 1 and detailed in Document 2. 10. ZONING AND ROAD CLOSING - 5780 FLAG STATION ROAD ACS2012-PAI-PGM-0161 OSGOODE WARD (20) That the Agriculture and Rural Affairs recommend Council: 1. Refuse a proposal to close portions of Flag Station Road and part of the unnamed Concession 2 road allowance leading to and abutting 5780 Flag Station Road; 2. Authorize staff to enter into a License of Occupation for a nominal amount of one dollar and one dollar payable annually to allow the owner of 5780 Flag Station Road to use the unmaintained portion of Flag Station Road and the Concession 2 road allowance as a private driveway to access their property; 3. Approve an amendment to Zoning By-law 2008-250 to change the zoning of 5780 Flag Station Road from Rural Countryside to Rural Countryside Exception [XXXr] as detailed in Document 2 and as shown in Document 1; and 4. That the implementing by-law not proceed to Council until such time as the owners of 5780 Flag Station Road enter into the License of Occupation for access to the property.
