REPORT RECOMMENDATION
That the recommend Council approve an amendment to the former Township
of Osgoode Zoning By-law to change the zoning of Part of 3461 4th
Line Road from RU (Rural Zone) to RU[349]
(Rural Exception 349 Zone) as shown in Document 1.

(zone d’espace rural) à RU[349] (zone d’espace rural avec exception 349) le
zonage d’une partie du 3461, chemin 4th Line comme l’illustre le
document 1.
BACKGROUND
The subject land is located on the east side of 4th Line Road, south of Springhill Road in the former Township of Osgoode. The site is flat and contains a residence, barn, garage and a shed. The surrounding lands are used for agricultural purposes.
This property has been subject to
a severance application to create a 0.8 hectare residential lot for a surplus
farm dwelling. The application was approved by the Committee of Adjustment on
March 12, 2007, subject to the condition that the retained lands be rezoned to
prohibit any residential uses. The retained land consisting of 21.67 hectares
of farm land is the subject of this Zoning By-law amendment application.
DISCUSSION
Official Plan
The Official Plan designates the subject land “Agricultural Resource Area”. Lands are designated Agricultural Resource with the intent of protecting the major areas of agricultural production and other lands suitable for agriculture from loss to other uses; and ensuring that uses, which would result in conflicts with agricultural operations, are not established in productive farming areas.
The Plan requires that where an application to
sever a surplus dwelling is made, the City will require that the vacant
agricultural parcel so created be rezoned to prohibit any residential use. This housing restriction is intended to
limit a pattern of lot creation in Agricultural Resource Areas that would see a
new residence being constructed on a vacant farm property, the house being
declared surplus and severed from a lot and the pattern so repeated.
Zoning By-law
The property is currently zoned “Rural (RU) Zone”. The current zoning permits a single detached dwelling, an agricultural and forestry use, a cemetery, a church, a public park and a private home day nursery.
Details of Proposed Zoning
The purpose of this rezoning is to limit the introduction of any new residential uses, which could lead to the creation of a new lot on the subject property.
The proposed zoning will allow for the agricultural land to be combined with a neighbouring farm operation.
The proposed zoning is considered appropriate for the site. The RU[349] zone exists within the Osgoode Zoning By-law and is used for this purpose. This restriction will ensure consistency with the 2005 Provincial Policy Statement and conformity with the City Official Plan. Therefore, the Department recommends approval of the rezoning proposal.
RURAL
IMPLICATIONS
The subject land will be limited to agricultural uses. By restricting residential uses, major agricultural areas will be protected from fragmentation and competing uses. In effect it will enhance a rural heritage and fortify the rural landscape.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
