REPORT RECOMMENDATION
That the Agriculture and Rural Affairs Committee recommend that Council approve the appointment of Stantec Consulting Ltd. as the engineer of record for the preparation of an engineer's report for modifications to the Tompkins Diversion to Grey's Creek Municipal Drain.

Diversion to Grey's Creek.
BACKGROUND
The City of Ottawa has received a request, from landowners planning land development, for modifications to the Tompkins Diversion to Grey's Creek Municipal Drain (formerly known as the Tompkins Branch of the Nolan Municipal Drain) located southeast of the intersection of Mitch Owens Road and Manotick Station Road. The Tompkins Branch of the Nolan Municipal Drain was originally constructed under By-law 19-1968 of the former Township of Osgoode. Under the report of an Engineer dated April 1988, the Tompkins Diversion to Grey's Creek Municipal Drain was constructed to divert flows south to the Grey's Creek Municipal Drain. A new Engineer's Report, under Section 78 of the Drainage Act (R.S.O. 1990), will address the modifications to the Tompkins Diversion to Grey's Creek Municipal Drain.
ENVIRONMENTAL IMPLICATIONS
Consultation and negotiation with the local Conservation Authority and Fisheries and Oceans Canada are being undertaken directly by the proponent. Upon the appointment of the Drainage Engineer, the local conservation authority will be notified, under Section 78(2) of the Drainage Act, of the proposed drainage works.
RURAL
IMPLICATIONS
The Tompkins Diversion to Grey's Creek Municipal Drain provides legal outlet for some rural roads and agricultural lands. The Engineer's report will address the modifications and any related flow capacity issues.
CONSULTATION
The affected landowners will be provided with a copy of the Engineer's Report and advised of the date and location of the meeting to consider the report.
FINANCIAL IMPLICATIONS
The costs of the new Engineer's Report are to be paid initially by the City of Ottawa, Wastewater and Drainage Services Division, Utility Services Branch, Public Works and Services Department, and recovered in their entirety from the developer upon completion of the report. Funds have been identified in the 2004 Capital Budget, internal order 902960 - Municipal Drains Improvements.
DISPOSITION
The completed Engineer's report will be subject to the Drainage Act approval process. Staff of the originating Department will conduct the necessary public and regulatory notification, and will table the completed report and associated By-law at standing committee and Council for consideration.
