Re: Harmonization and Integration of City By-Laws

Road Activity By-law

 

The City of Ottawa is continuing with the process of harmonizing and integrating the various by-laws from the former municipalities. A public consultation notification was forwarded to stakeholders in April, at which time we had requested initial input into the review process. We are now initiating the second phase of the consultation process as defined in our earlier correspondence. Enclosed is a copy of the draft Road Activity By-law (former Road Cut By-law), this document has been formatted to allow comments to be entered or issues identified opposite particular clauses.

The Road Activity By-law regulates the entry on, the cutting of,  and the reinstatement of the road allowance, not only by the City, but also by all utilities, developers and their contractors. This by-law protects the City’s infrastructure and facilitates the safe and effective movement of traffic through construction or maintenance activity zones.

 

This By-law includes provisions related to permit applications notification related to activities, insurance and securities, reinstatement and warranty, and fees and charges. Also noted are peak hour restrictions and the conditions under which roads may be closed.

 

Changes from the current By-law include, but are not limited to:

·        the extension of notification requirements and peak hour restrictions to all work activities on Schedule B roads. For none excavation activities the requirement is for notification only, no permits will be required;

·        the move to reference City Standards, rather than include the Standards in the By-law;

·        and under consideration for recommendation but not included in the attached draft is the extension of the Pavement Degradation Fees to all City roads. The cost impact of Utility cuts on local roads is scheduled to be completed by the end of June, at which time this matter will be further considered.
