The Council of the Regional Municipality of Ottawa-Carleton met at Haydon Hall, Regional Headquarters, 111 Lisgar Street, Ottawa on Wednesday, March 27, 1996 at 1:30 p.m.

The meeting was called to order at 1:35 p.m. and opened in prayer.

The Regional Chair, Peter D. Clark, presided.

The minutes of the Regular Council meeting of 28 February 1996 were confirmed.

COMMUNICATIONS*

  1. Association of Municipalities of Ontario (AMO) forwarding the following Municipal Alerts:
  2. Donna DuBreuil, President, Ottawa-Carleton Wildlife Centre, forwarding a copy of the Centre's 1995 Annual Report. The Report outlines the innovative volunteer service provided to the Ottawa-Carleton Region.

C. Bruce Campbell, Director of Labour Relations, Civic Institute of Professional Personnel, expressing support for the Region's position on the Home Care Program, at the meeting of 7 February 1996. The Institute feels it is important that the current system be maintained and that the proposed structure would be costly and unnecessary.

D. Wayne Robinson, Clerk/Human Resource Manager of the Township of Osgoode, forwarding a resolution adopted by Osgoode Council on 20 February 1996 endorsing the Region's request that the Ontario Government Advisory Committee on Ontario's Electricity System be asked to hold a hearing in Eastern Ontario.

E. Professor Barry Wellar urging Council to support the request for funding for the Pedestrian Safety Conference on 20 April 1996. NOTE: Item 1 of Transportation Committee Report No. 24 was approved by Council 28 February 1996.

F. Ann Borooah, Director, Housing Development and Buildings Branch, Ministry of Municipal Affairs advising that a motion was passed by the Standing Committee on Resources Development of the Ontario Legislature, which amends the transitional rules for apartments in houses (Bill 20). The provisions of Bill 120 respecting apartments in houses will continue to apply to the creation of second units where a building permit has been issued on or before the relevant section of Bill 20 is proclaimed into law. Third Reading and Royal Assent is expected to occur in the spring.

G. Georges Gratton, Société de transport de l'Outaouais forwarding an English version of the Regional and Interprovincial Rapid Transit System: Technology Selection Study - Final Report.

H. Thomas Derreck, City Clerk, City of St. Catherine forwarding a resolution adopted by its Council with respect to the effects of a provincial tax on the provision of critical services and economic well being of the Province.

I. Roch Davidson, Chief Departmental Correspondence Unit, Corporate Secretariat, Environment Canada writing on behalf of the Honourable Sergio Marchi, acknowledging receipt of Council's letter and report on the Deschêne Rapids Hydroelectric Dam Proposal.

J. City of Ottawa Councillor Elizabeth Arnold strongly urging Council to support the Transportation Committee's recommendation not to cut the cycling facilities implementation priorities projects on regional roads.

K. Linda Hunter, Chairperson, Ottawa Board of Education forwarding a resolution unanimously adopted by the Board, in response to a recent article in the Ottawa Citizen entitled "OBE Must Turn Over $14M to Provincial Treasury".

L. Joyce Trafford, General Manager, Carp Agricultural Society acknowledging the Region's support and extending thanks on behalf of the Society for the grant received from Regional Council. The contribution will help stage the Ontario Farrier's Competition at the 133rd Annual Carp Fair.

M. Carole Lacombe, Director, Office of Tobacco Control, Health Canada acknowledging receipt of Council's submission regarding Health Canada's tobacco control proposals. She advises the next step is to schedule a series of consultations with key stakeholders to allow Health Canada to collect and assemble information on the effectiveness and impact of the proposed measures. N. Correspondence received from the following Clerks of municipalities adopting resolutions urging the Minister of Finance to work with municipal governments in an effort to harmonize provincial and federal sales tax.

O. Robert Prowse, Regional Clerk, the Regional Municipality of Hamilton-Wentworth acknowledging receipt of RMOC's resolution on Community Care Access Centres. Mr. Prowse advises that Hamilton-Wentworth's Council does not take action on resolutions received by other municipalities, however he will circulate this information through the communications list to all Members of Council. P. Moira Winch, Clerk, Township of Goulbourn forwarding a resolution adopted by Goulbourn Council strongly supporting the use of the Ontario Provincial Police (OPP). They are very concerned that the new Police Services Board has not had an opportunity to fully study this matter prior to a decision being made by Regional Council. Goulbourn Council wants to ensure, on behalf of its residents, that police service will remain at a satisfactory level during the transition period and that service in the future will be equal to, and preferably superior to that which is now received from the OPP.

Q. Marlene Catterall, M.P. Ottawa West, forwarding copies of letters she has sent to federal Ministers concerning the proposed Aylmer Dam project and the possible impacts and concerns of constituents. R. Mrs. Sharon vokes, Clerk-Treasurer, County of Grey, forwarding a resolution adopted by Grey County Council expressing its strong objection to the creation of the Community Care Access Centres. NOTE: Community Services Committee Report No. 22 adopted by Regional Council 14 February 1996, refers.

S. Association of Municipalities of Ontario (AMO) forwarding the following Updates:

T. Mayor Dwight Eastman, Township of West Carleton, acknowledging receipt of the Region's resolution and noting their concerns regarding the creation of a National Capital Task Force on the Change Process Arising from the Quebec Referendum. NOTE: Motion No. 343 adopted by Regional Council 22 November 1995, refers.

U. Correspondence received from the following school boards objecting to the Planning and Environment Committee Amendment to Condition 60 for Subdivision 06T-92002, Phase IV, Part Lot 27, Concession VI, City of Kanata - Minto Development Inc.

Objection is to the amendment that would reduce from seven to four years, the period during which a school ground would be reserved for the board:

V. National Gallery of Canada advising Council that they share a valued partnership with the Ottawa International Jazz Festival and they support the Jazz Festival in its efforts.

W. Bob Streicher, Manager, Transportation Services, City of Nepean, responding to Councillor Cullen with respect to pedestrian concerns - Bayshore Drive at Woodridge Crescent - north intersection. He reports that the conditions at this intersection have been reviewed and confirms that pedestrian signals currently exist at all crossings of the intersection. The crosswalk lines and stop bars were worn and repainting will be undertaken in the spring. NOTE: Item 5 of Transportation Committee Report No. 23, adopted by Council 28 February 1996, refers.

X. Terry Mundell, President, AMO requesting the Region's support to convince the Minister of Municipal Affairs and Housing to proceed with the legislative amendments necessary to collect revenue from telephone subscribers in an effort to fund municipal 9-1-1 answering bureaus. A model resolution is attached.

COMMUNITY SERVICES COMMITTEE REPORT NO. 23

1. THE NEED FOR A COMMUNITY RESOURCE CENTRE IN SOUTH OTTAWA AND SOUTH GLOUCESTER

COMMITTEE RECOMMENDATIONS AS AMENDED

That Regional Council:

1. Endorse in principle the proposal made by the South Ottawa Gloucester Community Resource Action Team (SOGCRAT), in recognition that there is a need for community resource centre services in this area of the Region;

2. Direct that staff, prior to compiling recommendations for the 1997 budget, go to existing CRC's to re-evaluate their boundaries and financing to ensure that all areas of need have service available and make recommendations to increase this funding envelope;

3. Direct staff to investigate the possibility of allocating partial interim funding to SOGCRAT in partnership with the South East Ottawa Centre for a Healthy Community and the Gloucester Centre for Community Resources in order to assure that critical programs and services are offered in this area.

2. UPDATE ON LONG TERM CARE REFORM

COMMITTEE RECOMMENDATION, AS AMENDED

WHEREAS it is apparent that Ministry of Health's support for a shift to Community Care Access Centres (CCAC) is based on the Ministry's belief that not 100% of the funds dedicated to home care are spent on that program;

AND WHEREAS Regional Council believes that home care services in Ottawa-Carleton can be best provided by staff associated with the Ottawa-Carleton Health Department;

BE IT RESOLVED THAT Regional Council request that the Ministry of Health have its officials audit the Health Department's Home Care Division and if the audit shows that all provincial home care funding is spent on home care programs, that the RMOC be the CCAC for the Ottawa-Carleton region.

That Council approve the contract award to Ainley Graham and Associates Limited for Contract No. CC-6017 to provide detailed engineering design and construction administration services for the Carlsbad Springs Alternative Technology Water Supply in the amount of $785,000.00, conditional upon written confirmation by March 26, 1996 from the Provincial Minister of the Environment that the funding deadline will not be extended and that only the trickle-feed system will be considered for funding.

2. The next phase of Contract CC-4259 for CH2M Gore & Storrie Ltd. of Ottawa, Ontario to provide Contract Administration Services for the above contract, in the amount of $545,000, bringing the revised total contract provision to $978,000.

COMMITTEE RECOMMENDATIONS

That Council approve:

1. The award of Contract No. CW-5247 to Taplen Construction (1979) Ltd., (Ottawa), for the construction of the Ottawa South Reservoir and Pumping Station, for a total contract provision of $6,100,635.

2. The increase in scope to contract No. CC-5164 with Robinson Consultants Inc. (Kanata), to include contract administration and construction inspection services for the construction of the Ottawa South Reservoir and Pumping Station, in the amount of $742,000, bringing the revised total contract provision to $1,487,380.

3. The increase to the budget authority from $7,405,000 to $8,155,000 in Account No. 922-41610, Ottawa South Reservoir & Pumping Station. Funds are available from the previously identified $1,420,000 Reduced Regional Funding Requirement transferred to the Water Capital Reserve Fund from Capital Account No. 922-41610.

  1. The unit cost for the first price period, from the date of award to 31 January 1997, of $197.07 per metric tonne, based on estimated quantities, for a total contract provision of $192,279.90.

  1. The unit cost for the second price period (pending annual performance review, budget review and Council approval), 1 February 1997 to 31 January 1998, which will be no greater than $206.92 per metric tonne, based on estimated quantities, for a total provision of $195,961.81.

8. O.P.P. POLICING CONTRACT

COMMITTEE RECOMMENDATIONS AS AMENDED

That Council approve:

That Recommendation Nos. 1, 3 and 4 as outlined below, be referred to the Police Services Board for a report that addresses the following questions:

  1. What plan is proposed for expanding into OPP-policed areas?
  2. What needs analysis has been undertaken to justify these recommendations?
  3. How and when will the community be consulted?
  4. How many regional police officers would serve areas currently policed by the OPP?
  5. How many regional police detachments would there be and where would they be located?
  6. What are the capital start-up costs for this expansion? How will they be funded?
  7. What are the ongoing operating costs? What service levels are these cost projections based on?
  8. What is the status of the current amalgamation and is January 1, 1998 a feasible date for expansion?
  9. What is the potential for shared resources to help with any short fall in the interim period?

[Reference: Recommendation Nos. 1, 3 and 4:

1. That the Commissioner of the Ontario Provincial Police be advised that any contract for the provision of police services must allow Regional Council to assume responsibility for policing in any or all areas of Ottawa-Carleton on or before January 1, 1998, should this be practicable.

3. That the Ottawa-Carleton Regional Police Services Board, in cooperation with the Chief of Police, implement a plan for the assumption of policing from the O.P.P. which will result in the full regionalization of police services on or before January 1, 1998, should this be practicable.

4. That a copy of this report be forwarded to the Commissioner of the Ontario Provincial Police and to the Ontario Civilian Commission on Police Services.]

That the Commissioner of the Ontario Provincial Police be requested to commit those resources, determined necessary by O.P.P. staff to provide adequate and effective police service, set out in the "Proposal for Ontario Provincial Police Contract Policing" for Ottawa-Carleton and summarized in Annex "A", in keeping with the intent of Bill 143.

9. SALE OF SURPLUS LAND

BOWESVILLE ROAD AND OLD RIVERSIDE DRIVE

COMMITTEE RECOMMENDATIONS

That Council, pursuant to the legal closing of a portion of Bowesville Road:

1. Declare as surplus to Regional needs, that part of Bowesville Road; legally described as Part 1, Reference Plan 4R-11061 and Parts 1 & 2, Reference Plan 5R-12249 containing approximately 7,691 m2 of vacant land, as indicated on Annex "A", attached;

2. Declare as surplus to Regional needs, a portion of Old Riverside Drive, closed by by-law #225 in 1990 and legally described as Parts 4 to 13, Reference Plan 5R-12390 containing approximately 4,757m2 of vacant land, , as indicated on Annex "B", attached;

3. Accept an Offer from the Ottawa Hunt and Golf Club Limited in the amount of $150,000 for the lands described in recommendations 1 and 2, in accordance with the terms outlined in this report;

4. Approve the acquisition of approximately 144 m2 ( 1550 ft2 ) of vacant land from the Ottawa Hunt and Golf Club for the total consideration of $1.00, required for the construction of a cul-de-sac located immediately north of the portion of Bowesville Road to be closed, as indicated on Annex "A", attached. The construction of the cul-de-sac and the pathway will be at the expense of the Ottawa Hunt and Golf Club Limited. The pathway is to be maintained by the Ottawa Hunt and Golf Club.

DECLARATION OF INTEREST

Councillor B. McGarry declared an Interest on Item 9 of Corporate Services and Economic Development Committee Report No. 28, as he is a member of the Ottawa Hunt and Golf Club Ltd.

Councillor McGarry did not take part in the discussion or vote on this item.

DECLARATION OF INTEREST

Councillor W. Stewart declared an Interest on on Item 9 of Corporate Services and Economic Development Committee Report No. 28, as she is CEO of the Rideau Valley Conservation Authority, which is involved in litigation with a landowner on Bowesville Road.

Councillor Stewart did not take part in the discussion or vote on this item.

10. RE-APPOINTMENT: REGIONAL HOUSING AUTHORITY

COMMITTEE RECOMMENDATION

That Council approve the re-appointment of Mr. Chris Arnold, Ottawa, Ontario as one of the Region's four representatives on the Ottawa-Carleton Housing Authority, for a term beginning 1 February 1996 and ending 31 January 1998.

That Council approve the name of Councillor Michel Bellemare be submitted to the Association française des municipalités de l'Ontario (AFMO) for consideration to serve as the Regional representative on their Board of Directors.

COMMITTEE RECOMMENDATION

That Regional Council approve a grant of $35,000 to the Ottawa-Carleton 2001 Canada Summer Games Bid Committee, conditional upon equivalent support in services and kind from the area municipalities. Funds are to be provided from Provision For Unforeseen.

Pickard Environmental Centre in the amount of $296,100.00, bringing the revised total contract provision to $368,940.

WHEREAS local property tax is a tax levied by locally-elected officials (both municipal and school board) for local purposes;

WHEREAS previous provincial policies and funding reductions has virtually eliminated provincial funding to the Ottawa Board of Education, requiring the Board to rely on property taxes to fund public education in Ottawa, placing a heavy burden on local property taxpayers;

WHEREAS previous government commissions (including the recent Ontario Fair Tax Commission) have recommended reforms to the financing of education in Ontario, in order to provide equitable education throughout Ontario while relieving the burden on local property taxpayers, without any action being taken;

WHEREAS the Ministry of Education and Training, in March 1996, announced that the Ottawa Board of Education must provide to the Provincial Government $14 million of local property taxes collected locally for the purposes of public education;

WHEREAS the Provincial Government's demand violates the principle of local taxing powers granted to municipalities and school boards to meet local needs, to be determined by locally-elected representatives accountable to their electorate who pay the property taxes;

THEREFORE BE IT RESOLVED THAT the Regional Municipality of Ottawa-Carleton express to the Government of Ontario, through the Premier, the Minister of Municipal Affairs and Housing, and the Minister of Education and Training, its strong opposition to the Government's intention to divert locally set and raised property taxes to provincial purposes;

AND THAT this position be communicated to the local area M.P.P.s, to the Leaders of the Opposition Parties, to the Association of Municipalities of Ontario, and to local area municipalities and school boards.
