RESOLVED THAT Regional Council invite our Region's three government representatives, the Honourbable Norm Sterling, Mr. Gary Guzzo and Mr. John Baird to address Council and to hear the concerns of Regional Councillors on the recent provincial announcement concerning the transfer of service responsibilities and funding.

RESOLVED THAT A copy of the Finance Commissioner's Report dated January 22, 1997 "Impact of Provincial Announcements" be forwarded to the Premier of Ontario, and the Minister of Municipal Affairs and Housing, and further request information on how the province intends to address the negative impact that the current announcements would impose on our regions property tax payers.

COMMUNITY SERVICES COMMITTEE REPORT NO. 40

1. PRESENTATION BY "VOICES FOR REINVESTMENT"

COMMITTEE RECOMMENDATIONS AS AMENDED

That the Council of the Regional Municipality of Ottawa-Carleton add its name to the list of endorsers of "Voices for Reinvestment" and reiterate its position that reductions to hospital services are unacceptable without adequate and early investment in community and preventative services; and

That this resolution be circulated to area MPP's and to the Minister of Health.

2. NO-SMOKING BY-LAW IN PUBLIC PLACES

COMMITTEE RECOMMENDATIONS AS AMENDED

That Council approve the following actions:

1. Request that area municipal councils within Ottawa-Carleton develop or revise a public places smoking by-law with respect to restaurants, bars and pubs, using the provisions of Option 3 outlined in the report dated 14 November 1996 from the Medical Officer of Health;

2. Request that area municipalities within Ottawa-Carleton develop or revise their public places smoking by-law as necessary with respect to shopping malls, arenas/community centres, bingo halls, billiard halls and bowling alleys, using the provisions in this report;

3. Request that area municipal councils pass a resolution endorsing a regional smoking by-law for public places as stipulated in recommendations 1 and 2.

4. That the Medical Officer of Health be directed to prepare a No Smoking by-law using the provisions of Option 3 in the report dated 14 November 1996:

a) That Regional Council adopt "in principle" this new by-law;

b) That the by-law be circulated to all area municipalities with a request that they endorse the by-law;

c) That upon 6 or more municipalities adopting the terms of the by-law, Regional Council put the Regional by-law into effect and enforce its provisions region-wide.

5. WHEREAS public health is clearly a Regional mandate under provincial statute. and;

WHEREAS the current system results in considerable difficulty in effecting good preventative health measures;

BE IT RESOLVED THAT full jurisdiction for regulation of compliance/enforcement in public health matters be granted to the RMOC and that the Province of Ontario be asked to immediately effect this change.

COMMUNITY SERVICES COMMITTEE REPORT NO. 41

1. REQUESTS FOR CHILD CARE CAPITAL FUNDING

COMMITTEE RECOMMENDATIONS AS AMENDED

That Council approve:

1. A capital grant to New Edinburgh Child Care Centre in the amount of $210,000 conditional on provincial approval for the release of funding in the amount of $755,00 in provincial funds for the construction of a new child care facility and;

2. A capital grant to Garderie Sunflower Co-operative up to a ceiling of $125,000, with the final amount to be determined by actual costs less any provincial contribution and;

3. That $335,000 be transferred from the Child Care Contingency Fund to the Child Care Capital Reserve Fund for this purpose.

PLANNING AND ENVIRONMENT REPORT NO. 49

1. CONSERVATION AUTHORITY CORE SERVICES REVIEW

COMMITTEE RECOMMENDATIONS

That Council:

1. Receive this report on the Conservation Authority summary of services listed in Table 1 and described in the document entitled Regional Conservation Authorities 1997 Conservation Action Plan for the Regional Municipality of Ottawa-Carleton and approve;

a) that the "Basic Services" continue to be funded through the general levy with opportunities for streamlining to be pursued as outlined in the Action Plan, and;

b) that for the "Discretionary Services" as described in Table 2, the Conservation Authorities continue to seek out alternative funding sources and delivery mechanisms to minimize the levy requirements in the future;

2. Request that as part of the 1998 Budget process, the Conservation Authorities provide a status of efforts to secure alternative funding sources and delivery mechanisms for discretionary services;

3. Approve the "Principles" described in this report to guide future agreements regarding further realignment and re-evaluation of water resource roles and responsibilities;

4. Authorize the Regional Municipality of Ottawa-Carleton to enter into purchase service agreements with the Conservation Authorities, as necessary, to provide plan review functions.

2. DESIGNATION OF BY-LAW ENFORCEMENT OFFICERS -

SOLID WASTE COLLECTION BY-LAW

COMMITTEE RECOMMENDATION

That Council approve the appointment of persons' named in Schedule "A" as By-law Enforcement Officers for the purpose of enforcement of the by-laws, rules and regulations of the Regional Municipality of Ottawa-Carleton relating to the collection, removal and disposal of solid waste within the Regional Municipality of Ottawa-Carleton.

3. REGIONAL OFFICIAL PLAN REVIEW - PROPOSED

REGIONAL DEVELOPMENT STRATEGY: SELECT LINK

ANALYSIS AND SOUTHEAST GROWTH ANALYSIS

COMMITTEE RECOMMENDATION AS AMENDED

That Council approve that, notwithstanding the Regional Development Strategy, the assumptions and conclusions of the supporting documentation (including those of the Select Link Analysis), should be interpreted carefully, and that the application of these conclusions in the determination of development priorities should be done in the context of a five year review, the availability of Regional services and the Region's capital budget of the day.

PLANNING AND ENVIRONMENT REPORT NO. 50

1. CITY OF OTTAWA OFFICIAL PLAN AMENDMENT NO. 21

COMMITTEE RECOMMENDATION

That Council approve Official Plan Amendment No. 21 to the City of Ottawa Official Plan according to the Approval Page attached as Annex II.

2. LOCAL OFFICIAL PLAN AMENDMENT No. 36

CITY OF KANATA

COMMITTEE RECOMMENDATION

That Council direct staff to give notice of its decision to approve Amendment No. 36 to the Official Plan of the City of Kanata as modified on the Approval Page appended as Annex I.

3. PROVINCIAL AIRPORT POLICY REVIEW - POLICY OPTIONS

COMMITTEE RECOMMENDATION AS AMENDED

That Council forward the following report to the Ministry of Municipal Affairs and Housing as Council's position on the Provincial Airport Policy Review as amended by the following:

Be it resolved that the RMOC believes that any lands currently designated as "Residential" in any approved Official Plans should be "grandparented" and exempted from the effects of any new Provincial Policies regarding land uses around airports, and that staff forward this position to the Provincial Ministry.

RESOLVED THAT with reference to Item 4 of Planning and Environment Committee Report 50 Staff provide to Planning and Environment Committee's first meeting in March an updated report on a permanent Monday to Friday collection schedule to include public consultation with local community associations.

TRANSPORTATION COMMITTEE REPORT NO. 43

1. MONITORING OF RED-LIGHT VIOLATIONS AT TRAFFIC CONTROL SIGNALS

COMMITTEE RECOMMENDATIONS AS AMENDED

That Regional Council agrees with and supports the following:

1. Request the Province of Ontario to enact appropriate legislative amendments providing for the following:

a. video monitoring and enforcement of red-light violations at signalized intersections;

b. that such legislation be sufficient to prosecute the owners of vehicles found by camera technology to be violating red traffic light signals, without proof that they were, at the material time, the drivers of the vehicles;

c. enable municipalities to allocate the fine revenues from red-light enforcement, or a special grant or subsidy, to the costs of the installation, maintenance and operation of red-light monitoring systems, to the costs of adjudication, and to other safety measures;

2. Subject to the appropriate legislative amendments being enacted, the Environment and Transportation Department, in conjunction with the Ottawa-Carleton Regional Police Services, be authorized to undertake a "red-light monitoring/enforcement" pilot project.

3. That the Ontario Good Roads Association adopt a resolution to this effect.

2. DELEGATED AUTHORITY TO THE ENVIRONMENT AND TRANSPORTATION

COMMISSIONER - MOTION TC-26

COMMITTEE RECOMMENDATIONS AS AMENDED

That Council approve:

1. The Environment and Transportation Commissioner be authorized to establish;

a. bus zones;

b. bus time point zones;

c. school bus loading zones;

d. police vehicle zones;

e. excursion zones;

f. through highways;

g. stop control at intersections;

h. yield control at intersections;

i. multi-way stop control at intersections;

j. turn prohibitions, including cyclist and vehicular exemptions, where appropriate;

k. one-way highways;

l. truck routes appropriate load designations;

m. multiple lane highways;

n. pedestrian crossing prohibitions;

o. reserved bus lanes, and;

p. reserved bicycle lanes;

subject to Council approved and Departmental policies, following timely notification of the affected ward Councillors and in accordance with the provisions of Traffic and Parking By-law No. 1 of 1996, as amended;

2. The Corporate Policy Manual be amended by adding thereto immediately following paragraph 7.4.7.4 a new paragraph which reflects the delegated authority referred to in the previous recommendation, and which also authorizes the Environment and Transportation Commissioner to forward amendments to the Traffic and Parking By-law schedules, attributable to the delegated authority, directly to Council for approval without a separate report.

3. ROAD CUTS DIFFERENTIAL PRICING - INQUIRY TC-15

COMMITTEE RECOMMENDATION

That Council receive this report for information.

4. COOPER STREET AT O'CONNOR STREET - THROUGH PROHIBITION

COMMITTEE RECOMMENDATION

That Council approve the prohibition of eastbound through movements (bicycles exempted) on Cooper Street at O'Connor Street from 3:30 to 5:30 p.m. (Monday to Friday) and the amendment of the Traffic and Parking By-law to reflect this change.

5. LEES AVENUE AND MAIN STREET - TURN PROHIBITION

COMMITTEE RECOMMENDATIONS

That Council approve, on a six month trial basis:

1. the prohibition of southbound left-turning movements from Main Street to Lees Avenue from (3:30 to 5:30 pm Monday to Friday);

2. the exemption of bicycles from the existing southbound through and left turn prohibition (3:30 to 5:30 pm Monday to Friday) at Concord and Lees Avenues;

and the amendment of the Traffic and Parking By-law to reflect this change.

CORPORATE SERVICES AND ECONOMIC DEVELOPMENT COMMITTEE REPORT NO. 51

1. REGIONAL SOLID WASTE COLLECTION

CONTRACT CE-5244 - ZONE C

BONDING STATUS AND FINANCIAL REVIEW

COMMITTEE RECOMMENDATION

That Council approve that Exel Environmental be given formal written notice that it must furnish satisfactory contract security and financial guarantees and demonstrate consistent contract performance by February 28, 1997, failing which staff will report to Corporate Services and Economic Development Committee and Council on action that will protect Regional interests and meet public service responsibilities in accordance with the staff report and recommendations.

2. MEMORANDUM OF AGREEMENT - RMOC AND LOCAL 503, C.U.P.E

COMMITTEE RECOMMENDATIONS

That Council approve:

1. The attached Memorandum of Agreement between the Regional Municipality of Ottawa-Carleton and the Ottawa-Carleton Public Employees' Union, Local 503, C.U.P.E. dated 20 December 1996, subject to ratification of the agreement by CUPE 503 members;

2. The application of the attached provisions to CUPE 503 exempt staff, in accordance with Council policy.

BY-LAWS

NOTICES OF MOTION (FOR CONSIDERATION AT NEXT REGULAR COUNCIL MEETING)

WHEREAS a global reduction in emissions of greenhouse gases (GHG) is necessary to protect against climate change and possible adverse effects on human health, the physical environment, economy and quality of life;

WHEREAS industrialized countries, gathered at the United Nations Conference on Environment and Development in 1992, ratified a Convention on Climate Change committing countries to stabilize greenhouse gas emissions to 1990 levels by the year 2000;

WHEREAS current forecasts predict that Canada's GHGs could be in order of 13% above 1990 emissions by the year 2000 if no action is taken, thus falling short of its commitment;

WHEREAS since 1991 the Federation of Canadian Municipalities (FCM) has encouraged municipal governments to adopt a reduction target of 20% for CO2 emissions and has actively encouraged municipal governments to adopt policies and measures to reduce GHG emissions within their municipality;

WHEREAS FCM has just established a 20% Club to provide a forum for municipal governments to demonstrate their leadership on climate change issues and undertake to share their knowledge and experience with other municipal governments;

WHEREAS Club members commit to working towards reducing greenhouse gas emissions by 20% of 1990 levels first within their operations and, then throughout their municipal area by the year 2005 or within ten years of joining the FCM 20 % Club.

BE IT RESOLVED THAT the Council of the Regional Municipality of Ottawa-Carleton communicate to FCM its support for the 20% Club and its expression of interest in participating in the Club.
