REPORT NO. 6

1. WEST NEPEAN COLLECTOR - WOODROFFE DIVERSION

CONSULTANT SERVICES (CA-9472)

COMMITTEE RECOMMENDATION

That Council approve the appointment of Dillon Consulting Limited, Gloucester, to provide design engineering services for the Woodroffe Diversion on the West Nepean Collector for a total contract provision of $490,800.

2. TRAIL ROAD LANDFILL SITE - HOUSEHOLD SPECIAL WASTE DEPOT: WASTE HANDLING AND DISPOSAL (TENDER NO. 0906-74-T1/98)

COMMITTEE RECOMMENDATION

That Council approve the award of Tender No. 0906-74-T1/98 for waste handling and disposal services at the Household Special Waste facility, located at the Trail Road Landfill Site, to Drain-All Ltd., Gloucester, for a total contract provision of $247,438.75 for the one-year contract period from 1 April 1998 to 31 March 1999.

3. COMPREHENSIVE FIRE PROTECTION SYSTEM INSPECTION
AND MAINTENANCE CONTRACT AWARD: CONTRACT NO. CS-8816

COMMITTEE RECOMMENDATION

That Council approve the award of a sole source contract for a three year comprehensive maintenance contract (1 April 1998 to 31 March 2001) of the fire protection systems at the Robert O. Pickard Environmental Centre to Edwards Service Division, Nepean, Ontario for a total contract provision of $106,300.

That Council approve:

    1. The award of Contract 98-502 for the Installation of Underground Traffic Control Plant to O’Leary’s Limited, Ottawa, for a total contract provision of $410,275.66;
    2. The award of Contract 98-503 for the installation and maintenance of detector loops and lead-in cable to Mister Sealer Corporation, Ottawa, for a total contract provision of $65,537.50;
    3. A pre-commitment to the 1998 Operating Budget in Account Nos. 012-32525-2406, Signal Operations - General Road Maintenance in the amount of $86,200 and 012-32545-2406, Signals Capital/Other - General Road Maintenance in the amount of $650,000.

ADDITIONAL WORK - CONTRACT NO. CA-9407

COMMITTEE RECOMMENDATION

That Council approve additional work to Contract No. CA-9407 with Stanley Consulting Group Ltd., Kanata, for the preparation of the design and contract documents for modifications to intersections, street lighting, drainage systems and the provision of survey services for construction activities on March Road in the amount of $72,000, bringing the revised total contract provision to $161,000.

That Council approve:

    1. The award of contract CA9477 to Harmer Podolak Consultants Inc., Nepean, for the detailed deck condition survey and design for the rehabilitation of the Nicholas Ramp Underpass at the Southeast Transitway, Structure No. 604, for a total contract provision of $58,000;
    2. The award of Contract CA9478 to Trow Consulting Engineers Ltd., Nepean, for the investigation and design of masonry rehabilitation works at the Campus Transitway Station Pedestrian Underpass, Structure No. 816, and at St. Laurent Transitway Station, for a total contract provision of $39,000;

    1. The award of contract CA9479 to J.L. Richards and Associates Ltd., Ottawa, for the investigation and design of rehabilitation works for Structure No. 834, Pinecrest Creek Culvert at the Southwest Transitway and Highway 417 and Structure No. 835, Pinecrest Creek Culvert at the Southwest Transitway and Iris Street, for a total contract provision of $105,000;
    2. The award of Contract CA9480 to Ainley Graham and Associates Ltd., Gloucester, for the investigation and design of the station rehabilitation works at Blair, Train, Lees, Smyth, Westboro and Tunney's Pasture Transitway Stations, for a total contract provision of $119,000;
    3. A pre-commitment to the 1998 Capital Budget authority in Account No. 942-30629, Transitway Capital Rehabilitation Program in the amount of $300,000.

That Council approve:

1. The award of Contract No. 97-536, Confederation Heights Overpass and Brookfield Road Overpass Structure Rehabilitation on Regional Road 79 in the City of Ottawa to Thomas G. Fuller and Sons Limited, Ottawa, for a total contract provision of $2,134,870.31;

2. The appointment of Delcan Corporation, Ottawa, to provide professional engineering services during construction for a total contract provision of $42,000;

3. A pre-commitment to the 1998 Capital Project authority in Account 912-31059, Airport Parkway Structures, in the amount of $1,879,000.

That Council approve the pre-commitment of 1998 funds to extend the services of the Human Resources Information System (HRIS) programmer consultant from RHI Consulting to an upset limit of $110,000.

CORPORATE SERVICES AND ECONOMIC DEVELOPMENT COMMITTEE

REPORT NO. 7

1. PROPOSED NEW MUNICIPAL ACT- EXECUTIVE SUMMARY AND MINISTRY OF MUNICIPAL AFFAIRS AND HOUSING CONSULTATION DOCUMENT

COMMITTEE RECOMMENDATIONS

That Council approve the following:

    1. That the Regional Municipality express its appreciation to the Minister of Municipal Affairs and Housing for the fact that the Government of Ontario has at last undertaken a comprehensive review of the Municipal Act on the basis of commitments by the Government to produce flexible, less prescriptive, understandable and broad enabling legislation utilizing the natural person concept to enable municipal governments to function with initiative, imagination and greater autonomy and efficiency;
    2. That the Regional Municipality further express its disappointment to the Government of Ontario that the draft new Municipal Act circulated for consultation and comment has fallen far short of the government’s own responsible goals in that the new draft is possibly more prescriptive than the present legislation and provides for major interference in municipal functions by government Ministries by regulation;
    3. That the Regional Municipality recommends to the Minister that it is vital that the process of legislative consultation and review be continued so that the present draft legislation be used as a base for the production of a new Municipal Act that will be consistent with the legislative goals already established by the Government;

4. That the Regional Municipality further recommends that in the preparation of the new draft Municipal Act, the Provincial Government shall have regard to the issues, concerns and recommendations set forth in detail in the staff report and that legislation not proceed on the basis of the existing consultation draft document;

5. That this staff report be forwarded to the Minister of Municipal Affairs and Housing for consideration as the position of the Regional Municipality of Ottawa-Carleton.

That Council approve that Councillor Al Loney stand for election as the Region’s representative on the Federation of Canadian Municipalities Board of Directors for the remainder of this term of Council, to expire 30 November 2000.

PLANNING AND ENVIRONMENT COMMITTEE REPORT NO. 4

1. APPEALS # 14 AND # 26 TO THE MINISTER’S

NOTICE OF DECISION OF 1997 REGIONAL OFFICIAL PLAN AIRPORT NOISE POLICIES

COMMITTEE RECOMMENDATIONS AS AMENDED

That Council:

1. Approve a request to the Ontario Municipal Board, to modify theor the Minister of Municipal Affairs and Housing, Airport Noise policies of Section 11.6.1 of the Regional Official Plan (1997) as shown in Annex A as amended by the following, attached to this report":

"That the second paragraph of Section 11.6.1 Policy 3c) of the Regional Official Plan (1997) be modified to delete the phrase "may consider" and replace with "in lieu of a detailed noise control study" and add at the end of the first sentence "shall be implemented", and;

2. Approve a request to the Ontario Municipal Board,or the Minister of Municipal Affairs and Housing, with respect to the "Policies for Road, Rail and Rapid Transit Noise" of Section 11.6.2, to modify the Regional Official Plan (1997) as follows;that:

"That Policy 7 be modified to delete the reference to "and Energy’s" and that the date of "October, 1995" be replaced with the date "October, 1997".

COMMITTEE RECOMMENDATIONS AS AMENDED

That Council approve that:

1. The City of Gloucester Official Plan, which was approved in part on April 8, 1992, be further approved by the partial lifting of Deferral No. 1 pertaining to the designation of the Cyrville Core Activity Area and the Innes/Hwy 417 Activity Node, as outlined on the revised Addendum Approval Page V attached as Annex 1, and;

2. The request that this matter be referred to the Ontario Municipal Board by Aird and Berlis, Barristers and Solicitors representing Loblaw Properties Limited, be dismissed as frivolous and vexatious and only for the purpose of delay.

3. CITY OF OTTAWA COMPREHENSIVE OFFICIAL PLAN

LIFTING OF DEFERRED SECTIONS PERTAINING TO

COMMITTEE RECOMMENDATION

That Council lift Deferral Nos. 4, 16, 21 and 24 to the comprehensive Official Plan of the City of Ottawa and approve the corresponding parts of the Official Plan according to the Approval Page attached as Annex 1.

5. RESPONSE TO OUTSTANDING MOTION NO. P&E 14

Environmental Land Acquisition Policy

COMMITTEE RECOMMENDATIONS

That Council approve that:

1. Staff be directed to bring forward an amendment to the Regional Official Plan pursuant to Policy 2 of Section 5.4.5 of the 1997 Regional Official Plan;

2. Based on the Regional Official Plan amendment, staff prepare a report on revisions to the environmental land acquisition budget as part of its 1999 Budget submission.

TRANSPORTATION COMMITTEE REPORT NO. 6

SUSTAINABLE TRANSPORTATION

COMMITTEE RECOMMENDATIONS

That Council approve that the Association of Municipalities of Ontario and the Federal Canadian Municipalities be asked to lobby the Federal Government:

a) to establish a budget similar to the U.S. Department of Transportation’s support of public transit and construction thereof;

b) to develop a realistic on-going funding formula (i.e. access to fuel tax);

c) that Ottawa-Carleton be identified as a potential pilot for repetition in other communities.

MOTION

WHEREAS Terry Fox was a courageous young person who's 1980 Marathon of Hope to aid cancer research not only raised over $24 million dollars, but also inspired numerous Canadians to believe that most obstacles could be overcome by intense determination and sheer hard work;

AND WHEREAS on July 8, 1981, a short time after his tragic death, Regional Council sought to establish a fitting tribute to Terry Fox, a national hero, which would forever "record the capturing of the spirit of all Canadians" which occurred when his Marathon of Hope reached Ottawa-Carleton on July 1, 1980;

AND WHEREAS Regional Council allocated funds in the amount of $100,000 on December 9, 1981, for the creation of a life-size bronze statue, which was to depict a realistic portrayal of Terry Fox on his Marathon of Hope;

AND WHEREAS on September 17, 1983, the Terry Fox Memorial Statue was unveiled at its current location, southwest of the intersection of Rideau Street and Colonel By Drive, with a host of national dignitaries in attendance, including the Governor General of Canada and Mr. and Mrs. Fox;

AND WHEREAS Federal Heritage Minister Sheila Copps recently requested that Regional Council consider the re-location of the Terry Fox Memorial Statue to the newly proposed "Path of Heroes" - a route around Parliament Hill designed to prominently feature courageous Canadians;

THEREFORE BE IT RESOLVED THAT Regional Council give its approval to the request from the Federal Heritage Minister to re-locate the Terry Fox Memorial Statue to the new Path of Heroes in an effort to provide greater access and visibility to the Memorial;

AND FURTHER THAT the Arts Committee be delegated the necessary authority from Regional Council to liaise with all the appropriate parties to ensure that the will of Council is implemented in a timely fashion.
