RECOMMENDATION
BACKGROUND
For virtually 100 years, the two municipalities of Ottawa and Gatineau have co-existed, separated by the Ottawa River and also by a provincial border that has been largely invisible to area residents. During that time, police officers from both areas found the need to cross into the neighbouring municipality in the course of their duties. Investigations, surveillance operations, vehicle pursuits, searches involving the use of canine resources, major events and prisoner pick-ups have taken place in relation to both cities. These actions have taken place despite the fact that, as provincially appointed police officers, Québec and Ontario officers lose their status as police officers once they leave their respective provinces.
The status quo in the National Capital Region changed in June 2006 with a legal opinion in Gatineau that indicated our members may be at risk of civil and criminal liability if they entered the Province of Québec and became involved in any situation where use of force options are deployed. On 23 June 2006, a General Order (06-159) was issued by the Chief of the Ottawa Police Service prohibiting sworn OPS members from traveling to the City of Gatineau while on duty. There were three exceptions to the prohibition:
· OPS members with RCMP Supernumerary Constable appointments;
· Members who are engaged in fresh pursuit and who are following the principles and guidelines of Subject Apprehension Pursuit (SAP) can proceed into the Province of Quebec provided that the legal and policy provisions of fresh pursuit and SAP are fully complied with;
· Members who are required to attend Court in Quebec will be permitted to attend but must not be in uniform, nor armed, nor travel in a marked police vehicle.
A temporary solution was implemented to meet the daily operational needs of both police services to cross the Ontario-Québec border by appointing 259 members of the Ottawa Police service as Special Constables for the City of Gatineau and swearing in 153 members of the Gatineau Police Service as Special Constables for the City of Ottawa. The status was granted for one year in both cases. Upon the expiry of the appointments in May 2007, the Ottawa Police Services Board re-affirmed this approach by approving the appointment of 160 Gatineau Police officers as Special Constables in the City of Ottawa; the appointments also received approval from the Ontario Ministry of Community Safety and Correctional Services.
The Special Constable appointments approved by the Board and the Ministry of Community Safety and Correctional Services in 2007 will expire as of 30 June 2009. The Board is therefore asked to renew the appointments by approving the 188 individuals named in Annex A as Special Constables for a two-year term. The appointments as Special Constables will allow the individuals to exercise the powers of a Peace Officer in the City of Ottawa, in keeping with their duties as sworn members of the Gatineau Police Service.
For the past decade, police leaders across the country have been lobbying governments for a resolution to the problems of cross-jurisdictional and inter-provincial policing. Several years ago, under the leadership of the Law Amendments Committee of the Canadian Association of Chiefs of Police, model reciprocal legislation was developed that would have to be passed by every provincial and territorial legislature. Six provincial governments have since adopted similar legislation, but not Ontario or Québec. The Province of Ontario is currently reviewing it but has not yet introduced legislation. The model legislation is supported by the Canadian Association of Chiefs of Police, the Canadian Professional Police Association, the Canadian Association of Police Boards, the Canadian Association for Civilian Oversight of Law Enforcement, Justice Canada, Public Safety Canada, and the Canada Federal-Provincial-Territorial Deputy Ministers responsible for Justice. We remain hopeful that each province will pass legislation based on the legislative template discussed above.
There is minimal financial impact associated with these appointments.
CONCLUSION
In the absence of a permanent legislative solution, it is necessary to provide Special Constable status to Gatineau Police Service members for the City of Ottawa and seek the same status for Ottawa Police Service members in the City of Gatineau. Approval of the appointments addressed in this report will allow for the continuation of effective and seamless policing in the National Capital Region.
