DISCUSSION
The Delegation of Authority By-law 2001-12, approved by City Council on 8 January 2001, as amended, provides delegated authority to approve and conclude real estate transactions involving acquisitions and disposals of land and property. Schedule “F”, Section 24, provides the delegated authority to approve and conclude real property transactions at five staff levels.
Delegated authority to approve and conclude real estate transactions dealing with disposal of land and property are subject to the Disposal By-law 2002-38. All criteria of the said By-Law must have been met prior to the disposal by delegated authority.
Section 24 - 4C of the 2002-520 By-law requires that the exercise of delegated authority shall be reported to Corporate Services and Economic Development Committee on a semi-annual basis. This report covers the second half of the reporting period for the year 2003.
Real Estate Services certifies that all transactions approved under Delegation of Authority for the period of 1 July to 31 December 2003 are in compliance with the Delegation of Authority By-Law and Disposal By-law.
CONSULTATION
Public consultation not required.
FINANCIAL IMPLICATIONS
Prior to transaction approval, Real Estate Services staff confirms with Financial Services staff that the appropriate funds are available in the budget. The availability of funds is a condition of approval under delegated authority.
